These Terms and Conditions ("Terms") govern your access to and use of the SortWedPics website available at https://sortwedpics.com and any related applications, tools, and services (collectively, the "Service") operated by SortWedPics ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Service.
1. Agreement to Terms and Eligibility
1.1 By creating an account, accessing, or using the Service in any manner, you confirm that you have read, understood, and agreed to be bound by these Terms and by any policies referenced in them, including our Privacy Policy and Cookie Policy.
1.2 You may use the Service only if you are at least 18 years old (or the age of legal majority in your jurisdiction) and capable of entering into a binding contract. By using the Service, you represent and warrant that you meet this requirement.
1.3 SortWedPics is intended for both (a) consumer Hosts such as couples organizing their own Event, and (b) professional or business Hosts such as photographers, planners, and venues using the Service for their clients ("Business Users"). If you are using the Service as a Business User, you acknowledge that you are acting for purposes relating to your trade, business, craft, or profession and that certain consumer protection rights (including statutory cooling-off rights) may not apply to you under applicable law. If you register using a company name and valid VAT or business registration details, you will be treated as a Business User and not as a consumer for the purposes of these Terms, even if you are based in the EU or UK.
1.4 If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms, in which case "you" and "your" will refer to that entity.
1.5 If you are an EU or UK consumer Host, you may have a statutory right to withdraw from certain online contracts within a specified cooling-off period (typically 14 days) under applicable law. By placing an order for digital services that are to be performed before the end of the cooling-off period (for example, by starting to upload photos, invite Guests, or use AI processing), you acknowledge and expressly consent that we may begin providing the Service immediately and that, once performance has begun, your statutory right of withdrawal may be limited or lost, to the extent permitted by law. This is in addition to any voluntary refund rights we describe in section 8.7.
2. Definitions and Description of the Service
2.1 "Account" means a registered user account created to access the Service.
2.2 "Event" means a wedding or other celebration for which photos and guest information are managed through the Service.
2.3 "Host" means the person or organization that creates an Account to set up and manage an Event (for example, a couple or a professional photographer).
2.4 "Guest" means a person who is invited to an Event and may access shared galleries or links generated through the Service.
2.5 "User Content" means any content that you or your Guests upload, submit, or otherwise make available through the Service, including wedding photos, videos, guest information, comments, and other data related to an Event.
2.6 SortWedPics is an online service that helps Hosts and Guests find, organize, and share photos and other event content. Features may include: uploading and storing photos, AI-powered face recognition and grouping, creating personal galleries for guests, generating secure sharing links, managing guest lists and contact details, and other tools to help manage and share Event media. Facial recognition and similar features may, in some jurisdictions, involve the processing of biometric data; as a Host, you are responsible for ensuring that you have an appropriate legal basis (for example, valid consent or legitimate interests, where applicable) before enabling or using these features in relation to your Guests and other data subjects.
3. Modifications to the Terms and the Service
3.1 We may modify these Terms from time to time, for example to reflect changes to the Service, legal requirements, or business needs. When we make material changes, we will take reasonable steps to notify you, such as by email, in-product notification, or updating the "Last Updated" date at the top of these Terms.
3.2 The updated Terms will take effect when they are posted on the website (or, where required by law, when we notify you). Your continued use of the Service after the effective date of the updated Terms will constitute your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and, if applicable, cancel your Account.
3.3 We may change, suspend, or discontinue all or part of the Service at any time, including features, pricing, and availability. Where reasonably possible, we will provide advance notice of significant changes that negatively affect paid users.
4. Accounts and Security
4.1 To use certain features of the Service, you must create an Account and provide accurate and complete information. You agree to keep your Account information updated so that it remains true, accurate, current, and complete.
4.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You agree to notify us promptly at support@sortwedpics.com if you suspect any unauthorized use of your Account or other security breach.
4.3 We reserve the right to suspend or terminate your Account if we reasonably believe that the information you provided is inaccurate or incomplete, or if you have violated these Terms.
5. Intellectual Property Rights
5.1 The Service, including all software, code, algorithms (including face recognition models), design, interfaces, text, graphics, logos, trademarks, branding, and other content (excluding User Content), is owned by or licensed to SortWedPics and is protected by copyright, trademark, and other intellectual property laws.
5.2 Except as expressly stated in these Terms, no rights, title, or interest in or to the Service or any content are transferred to you. All rights not expressly granted are reserved by SortWedPics and its licensors.
5.3 Subject to your compliance with these Terms and any applicable payment obligations, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service solely for managing and sharing Event content for your own personal or internal business purposes.
5.4 You may not (and you may not permit any third party to) copy, modify, distribute, sell, resell, rent, lease, publicly display, publicly perform, reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restrictions are prohibited by applicable law.
6. User Content and License to SortWedPics
6.1 You (or your licensors, such as photographers) retain all ownership rights in your User Content. We do not claim ownership over your User Content.
6.2 By uploading, submitting, or otherwise making User Content available through the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, use, reproduce, process, adapt, modify (for example, to generate thumbnails or apply face recognition), display, and distribute such User Content as necessary to (a) operate and provide the Service; (b) maintain and improve the Service; and (c) comply with legal obligations.
6.3 You represent and warrant that:
(a) you have all necessary rights, licenses, and permissions to upload and use the User Content in connection with the Service, including rights from photographers and any third parties depicted in the content;
(b) you have provided all necessary notices and obtained all necessary consents from Guests and any other data subjects whose personal data is included in the User Content, as required by applicable data protection laws; and
(c) your User Content and your use of the Service do not infringe or violate any third-party rights (including intellectual property, privacy, or publicity rights) or any applicable laws.
6.4 We may use aggregated and/or anonymized data derived from your use of the Service and User Content (in a form that does not identify you or your Guests) for analytics, statistics, benchmarking, improving and developing the Service, and for other lawful business purposes.
6.5 We do not actively monitor all User Content but reserve the right (without obligation) to remove, disable access to, or edit any User Content that we reasonably believe violates these Terms, infringes third-party rights, or is otherwise unlawful or inappropriate.
6.6 From time to time, we may update, retrain, or replace the AI models and algorithms used in the Service. As a result, outputs and groupings (including face recognition results) may change over time and may not be consistent across different Events or processing runs, and we do not guarantee any particular outcome or consistency. We may also disable, restrict, or geo-limit certain AI features (such as face recognition) if we reasonably believe this is necessary for legal, regulatory, or ethical reasons, including in specific countries or regions.
7. User Obligations and Prohibited Activities
7.1 You agree to use the Service only for lawful purposes and in accordance with these Terms.
7.2 You agree not to, and not to allow any third party to:
(a) use the Service in any way that violates any applicable law or regulation, or for any unlawful, harmful, fraudulent, infringing, defamatory, obscene, or otherwise objectionable purpose;
(b) upload, share, or transmit any User Content that is illegal, offensive, hateful, discriminatory, harassing, threatening, pornographic, or that depicts individuals in a way that is likely to cause them harm or distress, particularly in the context of sensitive Events;
(c) upload or share content that you do not have the right to share, including copyrighted works, photos, or other materials without the permission of the photographer or rights holder;
(d) attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks, or to probe, scan, or test the vulnerability of any system or network;
(e) interfere with or disrupt the integrity or performance of the Service, including by introducing viruses, malware, or other harmful code;
(f) use any automated means (including bots, crawlers, or scrapers) to access or collect data from the Service without our prior written consent, except as permitted by applicable law (for example, public search engine indexing on publicly accessible pages);
(g) create accounts in an automated way or for the purpose of abusing free trials, promotions, or other offers;
(h) circumvent, remove, or otherwise interfere with security-related features of the Service, features that prevent or limit copying or use of any content, or features that enforce usage limits; or
(i) resell, sublicense, or otherwise commercially exploit the Service, except as expressly permitted in writing by us (for example, under a separate agreement for professional or enterprise use).
(j) use any AI-based features or outputs of the Service, including face recognition and groupings, to make or support decisions that unlawfully discriminate against individuals, or for high-risk purposes such as employment, creditworthiness, or insurance decisions about Guests or other individuals.
7.3 We may, at our sole discretion, suspend or terminate your access to all or part of the Service, remove or disable access to any User Content, and/or report any unlawful activity to the relevant authorities if we reasonably believe that you have violated these Terms or any applicable law.
8. Fees, Payment, and Refunds
8.1 Certain features of the Service may require payment of fees (for example, per-Event plans or professional plans). The applicable prices, billing frequency, and inclusions are described on our pricing pages or during the order process.
8.2 Unless otherwise stated, prices are inclusive or exclusive of taxes as indicated at checkout. You are responsible for any applicable taxes, duties, or similar governmental assessments related to your purchases, except for taxes based on our net income.
8.3 Payments are processed by third-party payment providers (such as Stripe) using the payment methods displayed at checkout. By providing a payment method, you represent that you are authorized to use that method and authorize us (and our payment providers) to charge all amounts due using that method.
8.4 For subscription-based plans (if offered), your subscription will renew automatically at the end of each billing period unless you cancel before renewal. You can cancel through your Account or by contacting us, but cancellation will not entitle you to a refund for amounts already paid unless required by law or our refund policy.
8.5 For one-off Event plans, fees are typically charged at the time of purchase and are non-recurring.
8.6 We may correct pricing errors or cancel an order if a clear error in pricing occurred, even after an order has been placed or confirmed, provided that no amounts have been irreversibly collected or, if collected, they are promptly refunded.
8.7 Unless otherwise stated on the website or required by applicable law, we may offer a standard voluntary refund period (for example, 7 days from the date of your first purchase of a particular plan) for certain plans, provided that (a) the Event date has not yet occurred, and (b) you have not substantially used the Service (for example, by sharing galleries with Guests or processing a significant number of photos). After this period or once the Event has occurred, all fees are generally non-refundable. Any statutory rights you may have as a consumer, including rights relating to withdrawal or refunds under applicable consumer law, are not affected by this voluntary refund policy and will prevail in case of conflict.
8.8 If we change the price of a subscription plan, we will give you reasonable prior notice and the new price will apply from the start of your next billing period. If you do not agree to the new price, you may cancel your subscription before the change takes effect.
8.9 Billing periods, renewal dates, and cut-off times for cancellations are calculated by reference to Coordinated Universal Time (UTC), unless otherwise specified during checkout or in your Account.
8.10 Consumer-specific rights and protections (including statutory withdrawal or cooling-off rights and mandatory refunds) generally apply only to Hosts acting as consumers and do not apply to Business Users, except to the extent that applicable law expressly provides otherwise.
9. Privacy, Data Protection, and Cookies
9.1 We collect and process personal data in connection with the Service, including (but not limited to) names, email addresses, login details, Event information (such as date and venue), guest lists and contact details, and User Content such as photos and related metadata.
9.2 Our processing of personal data is described in more detail in our Privacy Policy, which forms part of these Terms. Please review our Privacy Policy at https://sortwedpics.com/privacy-policy for information about what data we collect, how we use it, the legal bases for processing under applicable data protection laws (including the EU General Data Protection Regulation, where applicable), how long we keep data, and your rights.
9.3 We use cookies and similar technologies to operate and improve the Service, to remember your preferences, and to analyze usage. For more information, please refer to our Cookie Policy or the cookies section of our Privacy Policy.
9.4 Data may be stored and processed in the European Union (for example, in data centers located in the EU) and, where necessary, in other countries outside of your country of residence. Where we transfer personal data outside of the European Economic Area (EEA), the United Kingdom, or Switzerland, we will take appropriate safeguards, such as implementing standard contractual clauses or relying on other lawful transfer mechanisms.
9.5 You are responsible for ensuring that your use of the Service (including uploading User Content and managing guest data) complies with applicable data protection laws. In particular, if you are a Host, you are responsible for providing any required information and notices to Guests and, where necessary, obtaining their consent before uploading their personal data or photos to the Service.
9.6 For most personal data related to Events (including guest lists, contact details, and photos), the Host will generally act as the "data controller" (or equivalent under applicable law) and SortWedPics will act as the "data processor" processing such data on behalf of the Host. We will process such data only on the documented instructions of the Host, unless otherwise required by applicable law, in which case we will inform the Host (unless the law prohibits us from doing so).
9.7 We may use trusted third-party service providers as sub-processors to help us provide the Service (for example, hosting providers, payment processors, email delivery services, analytics providers, and customer support tools). Where we engage sub-processors to process personal data on our behalf, we will put in place appropriate contractual safeguards and require them to implement suitable technical and organizational measures to protect personal data.
9.8 If you are a professional or enterprise Host and require a separate data processing agreement (DPA), please contact us at support@sortwedpics.com. Where available, our standard DPA will describe in more detail our processing obligations, sub-processors, security measures, and data subject request handling, and will be available on request or at https://sortwedpics.com/dpa (or another link we may provide from time to time).
9.9 In the event of a personal data breach that is likely to result in a risk to the rights and freedoms of individuals, we will notify affected Hosts without undue delay after becoming aware of the breach and will provide information to help them meet any obligations to notify relevant supervisory authorities and affected data subjects, to the extent required by applicable law.
9.10 Where reasonably possible and as required by applicable law, we will provide Hosts with appropriate assistance to help them respond to requests from data subjects to exercise their rights (such as access, rectification, deletion, or objection) in relation to personal data processed through the Service.
10. Data Storage, Retention, and Backups
10.1 We aim to store Event content for at least the period communicated on our website or during purchase (for example, for a defined number of months after the Event, such as twelve (12) months after the Event date). However, we do not guarantee indefinite storage of any User Content or data.
10.2 We may delete or anonymize your User Content after a reasonable retention period or when it is no longer needed for the purposes for which it was collected, subject to any legal obligations to retain data for longer.
10.3 While we take reasonable technical and organizational measures to protect and back up data, you acknowledge that no system is fully secure or fail-proof. You are responsible for maintaining your own backups of important content, such as original photos and guest lists. To the maximum extent permitted by law, we are not liable for any loss or corruption of data, except as expressly provided in these Terms or required by applicable law.
11. Disclaimer of Warranties
11.1 The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.
11.3 In particular, you understand and agree that:
(a) AI-powered face recognition and guest-matching features are probabilistic and may not always correctly recognize or group individuals;
(b) not every photo or guest will necessarily be detected or correctly assigned; and
(c) you remain responsible for reviewing and, where necessary, correcting labels, assignments, and sharing settings before sharing galleries with Guests.
11.4 Nothing in these Terms is intended to exclude or limit any warranties or rights that cannot be excluded or limited under applicable law, especially if you are a consumer.
12. Limitation of Liability
12.1 To the maximum extent permitted by law, neither SortWedPics nor its affiliates, officers, employees, or licensors will be liable for any:
(a) indirect, incidental, special, consequential, or punitive damages;
(b) loss of profits, revenue, business, or anticipated savings;
(c) loss or corruption of data or User Content; or
(d) loss of reputation or goodwill,
arising out of or in connection with your use of (or inability to use) the Service, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
12.2 To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Service will be limited to the greater of (a) the amount you have paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty (50) euros.
12.3 The limitations in this section do not purport to limit liability that cannot be limited under applicable law, such as liability for death or personal injury caused by negligence, or for intentional misconduct.
13. Indemnification
13.1 You agree to indemnify, defend, and hold harmless SortWedPics and its affiliates, officers, directors, employees, and agents from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
(a) your use of the Service or your User Content;
(b) your violation of these Terms or any applicable law or regulation; or
(c) your infringement or misappropriation of any third party's intellectual property, privacy, or other rights, including use of photos or other content without the necessary permissions from photographers, Guests, or other rights holders.
13.2 We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.
14. Suspension and Termination
14.1 You may stop using the Service at any time. If you wish to close your Account, you may do so through your Account settings (if available) or by contacting us at support@sortwedpics.com.
14.2 We may suspend or terminate your access to all or part of the Service, or close your Account, if:
(a) you materially or repeatedly breach these Terms;
(b) we are required to do so by law or by a court or regulatory authority; or
(c) we decide to discontinue the Service in whole or in part.
14.3 Upon termination of your Account, your right to use the Service will cease. We may retain or delete your User Content in accordance with our data retention practices and Privacy Policy.
14.4 When your Account is closed or your access to the Service is terminated, we may disable guest access to Event galleries and sharing links immediately or after a reasonable grace period. We may retain your User Content for a limited retention period after termination to allow you to request an export of your data, after which we may delete or anonymize the data, subject to any legal obligations to retain it for longer. Where technically feasible, we will provide reasonable means for Hosts to export their User Content (for example, via bulk photo downloads) before deletion.
14.5 Termination (by you or by us) will not affect any payment obligations that have already accrued or any rights and remedies that have arisen prior to termination. Sections that by their nature should survive termination will continue to apply, including, without limitation, sections relating to intellectual property, User Content license, disclaimers, limitation of liability, indemnification, and governing law and dispute resolution.
15. Governing Law and Dispute Resolution
15.1 These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) will be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
15.2 If you are a consumer residing in the European Union, you may also benefit from any mandatory provisions of the law of your country of residence, and nothing in these Terms affects your rights as a consumer to rely on such mandatory local provisions.
15.3 Before initiating any formal legal proceedings, you agree to first contact us at support@sortwedpics.com and give us a reasonable opportunity (for example, thirty (30) days) to resolve the dispute informally.
15.4 Subject to any mandatory provisions of applicable law, the courts of Amsterdam, the Netherlands, will have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or your use of the Service.
16. Miscellaneous
16.1 These Terms, together with any other policies or terms referenced in them (such as our Privacy Policy and Cookie Policy), constitute the entire agreement between you and SortWedPics with respect to the Service and supersede all prior or contemporaneous agreements, proposals, or communications relating to the Service.
16.2 If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
16.3 You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
16.4 Our failure to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision.
